U.S. Congressman Proposes Ban on Candidates Trading Election-Related Prediction Market Contracts
Democratic Congressman Don Davis from North Carolina has introduced the "Ban on Betting on One's Own Election Act," which aims to prohibit federal candidates from trading contracts related to their own elections in prediction markets. Violators would face a fine of $10,000 or three times their net trading profits, whichever is higher. This proposal stems from an incident involving Davis's Republican opponent, Laurie Buckhout, who was penalized by Kalshi for trading contracts related to her candidacy, resulting in a payment of approximately $2,600 in fines and a three-year suspension from using Kalshi. Prediction market platforms have already restricted candidates from trading contracts related to their own elections to prevent insider trading. Davis hopes to formally enshrine these restrictions into law, but the House and Senate plan to reconvene only after the midterm elections, making it nearly impossible for this proposal to be implemented during the current election cycle. The Senate passed a resolution in April banning senators and staff from participating in prediction market trading, but it does not cover candidates who are not currently serving senators.
