U.S. Treasury Department Withdraws Two Cryptocurrency Regulation Proposals
The Financial Crimes Enforcement Network (FinCEN) of the U.S. Treasury Department has withdrawn two regulatory proposals aimed at cryptocurrency mixers and personal wallets. The proposals would have imposed additional identification, record-keeping, and reporting obligations on financial institutions. The 2023 proposal classified international cryptocurrency mixer transactions as a high-risk category for money laundering. FinCEN cited concerns that the overly broad scope could hinder legitimate transactions made for privacy purposes and impose a heavy reporting burden on financial institutions. The other proposal from 2020 required identification and record-keeping for certain transactions over $3,000 involving personal wallets, and reporting to the agency for transactions exceeding $10,000. In its withdrawal notice, FinCEN stated that this step is part of ongoing efforts by the Trump administration to ensure that digital asset regulations are fit for purpose. Since neither proposal went into effect, the decision does not change existing obligations. FinCEN indicated that it will continue to monitor the illegal use of mixers and may take new steps in the future.
